1 Validity of the GTC and conclusion of the contract

1.1 These General Terms and Conditions (GTC) apply to purchase contracts with private customers and companies concluded via the website of the Provider.
1.2 The order is confirmed by the provider. The contract is concluded as soon as the confirmation is received by the buyer. If the confirmation is not received within a reasonable period of time, the Buyer shall consider it as a rejection of the order and shall be entitled to conclude the contract with another supplier.

2. prices and special offers

2.1 Prices are quoted in CHF. VAT and advanced recycling fee and processing are included. Shipping costs will be charged extra.
2.2 The Provider reserves the right to change the prices at any time. The prices published on the website on the date of the order are valid for the customers.
2.3 The conditions for promotions and discounts are available at the relevant information.
2.4 The lowest price guarantee is only valid for equivalent stores, for no auctions, no offers limited in time or quantity and is only valid if these products are also in stock at the desired stores. Furthermore, we cannot sell the products cheaper than for the minimum selling price set by the manufacturer.

3. delivery conditions

3.1 Delivery is normally made within 3-5 days. If a longer delivery time is necessary, the supplier is not liable for this.
3.2 We fully guarantee all packages for domestic shipments until delivery. We are not liable for successfully delivered packages that disappear at the front door.
3.3 Shipping charges are displayed before confirming the order. The buyer accepts these at the conclusion of the order. If the actual shipping charges differ from the charged amount, there is still no right to a refund of any kind.
3.4 For returns / exchanges, the provider reserves the right to charge the buyer a fee of 10% of the value of the goods, or a flat rate of CHF 10, plus the shipping fees paid as processing fees.

4. right of withdrawal and rescission

4.1 Customers may cancel the purchase contract within 7 days without giving any reason and without penalty provided that the product has not been used and the packaging has not been opened. The period for exercising this right begins on the day on which the goods arrive at the consumer. The customer may return goods already delivered at his own expense. Payments already made will be refunded by the provider free of charge. The shipping fees must still be paid. If the delivery was free of shipping costs, the buyer will be charged the actual shipping costs.
4.2 If a Customer withdraws from the purchase due to defects in the Goods for which the Provider is responsible, the Provider shall refund any amounts already paid as well as the return costs.

5. liability and warranty

5.1 Unless expressly agreed otherwise, the statutory warranty provisions shall apply.
5.2 The Buyer shall inspect the delivered goods as soon as possible and report any defects immediately.
5.3 If there is a warranty case, the customer must send the goods by mail. The postal charges are for the account of the customer. The supplier reserves the right to keep the goods for several days for thorough inspection.
5.4 In the case of returns that are against the warranty conditions set by the provider, the provider reserves the right to charge the customer processing & shipping fees up to CHF 50.

6. payment

6.1 All orders are paid in advance by credit card or bank transfer. We debit the payment amount upon receipt of the order.

7. liability for the online connections and data protection

7.1 The Provider undertakes to ensure security in accordance with the current technical state of the art in systems, programs, etc. that belong to it and over which it has influence, and to comply with the rules of data protection.
7.2 Customers shall ensure the security of the systems, programs and data within their sphere of influence. In their own interest, customers should keep passwords and user names secret from third parties.
7.3 The Provider shall not be liable for defects and malfunctions for which it is not responsible, in particular for security defects and operational failures of third-party companies with which it cooperates or on which it is dependent.
7.4 Furthermore, the Provider shall not be liable for force majeure, improper actions and disregard of risks on the part of the Customer or third parties, excessive use, unsuitable operating resources of the Customer or third parties, extreme environmental influences, interventions by the Customer or disruptions by third parties (viruses, worms, etc.) that occur despite the necessary current security precautions.
7.5 All personal data will be treated as strictly confidential and will only be passed on to other companies if necessary for order processing. The Provider is entitled to transfer the personal data to affiliated companies for the purpose of credit checks and credit monitoring within the framework of a data exchange. You can view and edit your user information at any time in the protected area of the homepage after logging in.

8. application of law and place of jurisdiction

8.1 These GTC shall be governed by Swiss law, namely the provisions of the Swiss Code of Obligations.
8.2 The Provider reserves the right to change the present general business relations at any time. The respective binding version of the GTC can be viewed at thedurand.ch/agb. The place of jurisdiction is the registered office of the provider.
